We are Travel Magica and we look forward to the opportunity to act as an online portal for your need to connect with various vendors of services in travel industry. These terms and conditions (the “Agreement”) describe what you are legally entitled to expect from us when you purchase travel related services through us, in addition to your obligations as a customer. The terms “we”, “us” and “our” refer to Travel Magica & “you” “yours” “your” refers to the customer visiting on our website, this website user & otherwise using our services.

These terms and conditions are applicable to the usage of the (“TRAVEL MAGICA” by you. The website is for your education and information and is also used by us to obtain feedback with a view to providing information and services with respect to the tour, travel industry.

Disclaimers Related to the Service we offer.

We help your get connected with various vendors in travel industry for taxi, hotels & anything other required in the travel which is requested by you. We also connect you to travel agents, tour operators, companies which are offering service that you might be interested in to purchase.

We can only be called a medium of contact. However, we do not guarantee any of such service from any of our vendors as we do not personally verify their identity, we will try to collect the identity & other contact related information so that you can reach them in case want to contact however we do not take any responsibility of the information to be authentic in any manner or in case of our inability to provide any information related to the vendor. We work as a medium to pass requirement and services that you might be looking forward from us or you have raised an inquiry on our website or in our marketing network by filling up form online or offline, writing emails or a direct phone call to us.

We can only be called a medium of contact between you and various services providers across the country or outside the country. We recommend all of our users & customers to insure to perform a cross check on all possible information that they want before they purchase any service from any of the vendor we connect you to.

Group Departure and Campaign Pushpak related Terms & Conditions.

Definition of Terms Used.

What is Pushpak?: Pushpak is a name of campaign given to the fixed departure based group travel activity by Travel Magica to facilitate travelers who’re looking for group tour packages. 

Registration in Pushpak: A activity of customer sharing their basic details on a digital or physical medium to the Travel Magica for a pre-reservation review for final decisioning over their eligibility for Onboarding Enrollments.

Onboarding Enrollments in Pushpak: An activity by company and customer to initial customer enrollments and adding their names in que for next travel date allocation basis availability.

Document Validation in Pushpak: A backend activity by company to validate customer’s documents to process the service.

Allocation of Travel Date in Pushpak: An internal activity of the company in which company notifies the available travel dates to the customer and customer acknowledges and picks the preferred dates of travel.

Reservation in Pushpak: Internal reservation processing by company for taking allocation of hotel rooms, seats in flights, transportation route planning, service blocking against money or security.

The offered package cost, does not include, personal expenses by customer(shopping, tips, camera, photoshoot, any documents processing cost, any other cost that not included in package of the service & exigencies during travel.

Campaign Pushpak offers accommodation in double or triple or shard Dorms based accommodation either with your co-travelers or your colleagues. If wish to opt for separate the rooms or hotel or other service, extra charges would be payble by customers and no deduction or adjustment in primary cost can be facilitated.

After the succesfull “Onboarding Enrollment” or after lending approval by Partners or by Travel Magica, onboarding enrollments fee would not be refunded. It’s only refundable in a condition where Travel Magica is unable to offer convenient partial payment plan to the customer.

After succesfull disbursal of the travel loan by either one party, cancelling the passenger onboarding is not allowed, in case any exception, real time condition would be revised and final decision over charges or cancellation would be shared, as per the conclusion of the final decision, refunds and cancellation charges would be shared with guest and be charged accordingly.

Exchange of person is not allowed if reservation is processed then no changes would be accepted after reservation.

Travel Magica funded trip option shall be optional to different individuals and exclusively given after consent by the company after reviewing the requirement, customer would be given travel dates 3 months prior with having a minimum 85% of the payment received to the company.

In case any customer chooses to be associated with Trip Funded by Travel Magica, a minimum of 50% of the total payment need to be paid the customer.

Travel Magica will not be responsible for any loss of any guest due to missed flights, missed any service, customer not reached the meeting point timely, not reached boarding point timely, not reached gathering point timely, in such condition any expenses occurred due the act shall be paid by guest.

Pushpak Trip Managers are not responsible for personal assistance, incase any traveler need personal assistance, please carry necessary support person on charges as per the company.

The allocation of travel date is basis the final decision by the company and as per availability option, incase no availability on dates requested by customer, Travel Magica would be allocating the travel date as per the availability.

In case reservation is successful and trip needs to be cancelled by the customer due to any pandemic, administrative restriction, sickness or illness or hospitalization or any other reason, Travel Magica shall not be responsible for 100% refund and Travel Magica will be processing it as a general cancellation as per the policy defined under Pushpak campaign terms of service. For customer to cover the loss, necessary travel insurance recommendation would be shared by Travel Magica prior “Onboarding Enrollments”, basis the which if customer bought the travel insurance then associated travel insurance company shall be the party of contact for the possible returns for the losses basis their terms which shall be completely separate and excluded from the support and service limits of Travel Magica.

If any customer raises any dispute with any co-travelers or Pushpak Trip Manager or with any other subject that is impacting the trip for the group, then Travel Magica can separate the person from the group and ask the person to manage the trip own their own with assistance over retuning back to India.

People with this category would not be allowed to travel if identified as, Seriously sick, Illness, Sick with infactious Disease, Pregnancy, Irregular High or Low Blood Pressure Disease, Serios Illness, Heart Patient, Regular Dialysis, On regular medical assistance and any other service type of sickness that can make a person serious during trip.

All customers are required to sign a physical copy of “Self Acknowledgement” prior travel, for their confirmation of understanding the requirement of fitness, language they understand or speak, risk of travel services, agreeing to adherence to the guidance by Pushpak Trip Managers of Travel Magica and agreeing to the Terms of the Company that it can take all necessary decision that can ensure safety of all travelers first instead of one or a few travelers. 

During the travel in case any customer met with any accident, injury, death, monetary loss, item theft or anything things that is tragic incident, Travel Magica shall not be held responsible for the incident at any condition, as a company we can try to take all precaution and safety of every traveler and also share guidance to the customer however Travel Magica does not guarantee that such incidents can not take place and it should be sole responsibility of the travelers over hospitalization, monetary loss, re-arrangement of transportation other expenses related to the incident.

Travel Magica offers, 100% charges free monthly EMIs without date restriction, in case payment delayed 1 month there is no changes or action taken, the shortest travel arrangement is done with 3 months of payment plan therefore, guest are requested not to delay the payments for more then 2 months and clear all dues all previous months, to avoid service be hold or changes in travel date allocation or late payment fee or charges against payment plan inefficiency.

After successful disbursal of the loan or successful enrollment, in general conditions, company shall communicate the travel date to the customer within next 3 to 4 months, however this travel date allocation may take longer time in allocation, if low pool size, un-availability of resource, administrative restriction, pandemic or anything other company shall not accept cancellation for the reason of delay in travel date.

Tour Package & Other Service Related Payments, Cancellation & Services Related Terms.

Please read our policies with which we are abiding you to our internal business processing system and if you continue to buy or use any of our service you are abide by the policies shown below.

Payment Policies for Tour Packages

1- 10% Payment as token amount at the time of booking – This does not reserve any of your service but provide a package booking confirmation by Travel Magica.
2- Second payment amount 45% needed after the verification successful, then we will process the hotels booking & taxi reservation only.
3- Third payment is required right after the reservation confirmation from Travel Magica.
4- You can hold up to 30% payment and pay this amount on arrival when you reach your travel destination & maximum due by second day of your travel.

5- While processing the service, we notify every customer for a payment due date through SMS or calls or electronic communication medium only or guest portal notification, for making payments, in any case if any customer is not paying the payment before the payment due date, in such case late payment fee will be applicable as per notification.

Your successful and on time payments from you can make us enable hold a reservation for you for a limited time period and fully based on the terms of service of the reservation provider. A minimum of 85% payment is required to confirm your booking and to provide you the confirmation IDs or vouchers. We will advise you of the date when we need payments from you based on the requirement to facilitate your service. We may not accept bank Cheque as a method of payment. In case of partial payments, we will share the booking vouchers only after full payment is made. Any deposit from you is valid for 6 months only. After full payment, the conditions of the contract with our supplier may permit them to increase the cost of your arrangements or because of non-availability, blackout-period or caused by any other reason. In such case, we will notify you for such increments to be paid to us. For more information on our policies please read our key policies listed below.

Please note all preset itinerary emails and tour package plan sent by our executive could be promotional and preset in which name of hotels, route, schedules and services may differ depending on the real time availability of resources, weather condition or any of the other situation. Therefore, to ensure no issues in your travel a finalization by our booking team for such things will be considered to be processed further.

Call us at least 10 business days prior to the travel date to amend bookings. Cancellation of the bookings will not be entertained and no refund request can be facilitated if not informed at least 10 business days before your travel date. Even if the cancellation is processed by us, we will not be in a position to get you the refund due vendors & suppliers involvement or may process a partial refund with charges.

In case of cancellation due to any reason, if informed or not informed 10 business days before departure date cancellation, cancellation charges will be applicable as cascaded by our vendor, supplier & by us.

In case of “No Show” (A condition where-in we are unable to contact you after continue attempt for 3 days to reach you through email or a phone call, wherein we will either call you at least once or send you an email) in such case there will not be any refund, 100% charges will be taken.

In case of any urgent booking (urgent time period is anytime less than 7 days), we would only be in a position to tell you about the option available by us to be booked or reserved but do not guarantee satisfactory services.

In the case of an urgent travel (any time less than 7 days) we do not guarantee the certainty for the reservation of your hotels, travel or anything else & in case of any extra charges are billed, we will notify you for such information and you need to pay such increments.
Please note that we do not entertain any refund or cancellation request in case the travel date is within 25 days & no refund can be possible.
In case of successful cancellation & refund requests, please note that this period may take 45 days to refund you the money.

We need to receive from you, your original voucher before any applicable refund can be considered. After successful cancellation of the bookings, we will notify you the subsequent date and the amount that will be refunded. In case of cancellation, 35% cancellation charges by us & if any other by our vendors or suppliers charges are accumulated, will be applicable.

We may reschedule the sightseeing days subject to weather conditions or resources availability to ensure smooth execution of tours.

 

 

Trip Insurance Related Terms.

 

 

As a travel service consultant, we understand some un-certain issues during travel which are caused by nature, schedules, traffic, delay, disasters, natural calamity, accidents, theft, exigencies, medical issues, epidemic, injury or death and anything other that can be called an issue in completing your travel from home to back home. We highly recommend every one of our customers to buy a travel insurance to cover themselves from these types of issues and want to express a term that you must not travel without a travel insurance as we are not providing any cover for these type of risk nor taking any responsibility or liability for such issues. We suggest you to buy a  travel insurance policy and it’s totally between you and your travel insurance company for how they cover you. Please read and understand your travel insurance policy documents appropriately before you want to buy any insurance from any of our recommendation or non-recommendation insurance provider.

In case of non-availability of resources, we will ask you change your travel date or plan your travel in a later date or if any way the travel is possible with higher charges then ask you to pay the difference amount.

As an audit on quality service, any proposal or quotation from our side might get re-evaluated by our team to avoid issues during travel. In such case, the finalization of package for hotels, total price, taxi, flights, trains or anything else provided to you in package itinerary or quotation email will only be considered finalized once re-evaluated and approved by our team and in such case we will confirm you the changes in written.

Reservation of hotels and other travel related services may face availability issues generally due to online inventory or blackout period, we may not be able to provide you a confirm booking in blackout period.

Please note that air-conditioner in car or in hotel will not work in high hills or in winter seasons.

In case the client is carrying any valuable personal good, it is advisable not to leave it behind at the time of disembarking/ leaving the coach. We will not be held responsible or liable in case of loss of such items. All baggage and personal goods are at all times and in all circumstances, the responsibility of the traveler.

We recommend all of our customers to purchase travel insurance policy before they travel to any destination as we do not take responsibilities of medical bills, injuries, death, accidents or any other problem occurred due to travel.

If we are acting as your travel agent, we will pass on any such increase to you as we become aware of such increase. If we have arranged a package, changes in transportation costs including the cost of fuel, taxes, fees and exchange rates mean that the price of your travel arrangements may change after you have paid in full.

If the Client is willing to amend or cancel his/her booking because of whatsoever reasons including accident, illness, or any other personal reasons including non-payment of the balance payment, the company is liable to recover Cancellation charges from the Client. All cancellations are to be communicated in written and advance amount is refundable after cancellation and booking charges.

CHILD POLICY:-

  • Children below 5 years are complimentary in parent’s room without extra bed
  • Children above 7 years will be charged as an adult.
  • We do not make Pre-Arrangements for infants, for milk, baby stroller or anything else.

PREPONE AND POSTPONE

For postpone/pre-pone of tour packages are to be communicated in written and need to be informed us at least 14 days prior and only in the case where we have not initiated to any booking with which postpone/pre-pone charges may apply which will be notified at the time of communication with company depending on the vendor or supplier charges or availability.

Virus & system issue, Opening an Account & Usernames/Passwords

In the event you have reason to believe your account, username or password is being used in an unauthorized manner, you agree to contact us promptly so that the appropriate modifications can be made to your account. You are solely responsible for the confidentiality of your username, and password. Please be aware that information will be sent to your email address that you provided to us at the time of sign up. In order to become able to use the TRAVEL MAGICA, you must complete in full an application form on the Website. As part of the application, you will be asked to provide us with a Username and Password. This username and password will be used by you when using our services.

Any activity you do on the website becomes property of TRAVEL MAGICA. We reserve the right to modify or update that information suitably. You hereby consent to the receipt of physical & electronic communication from us.

TRAVEL MAGICA is neither responsible nor liable for any viruses or other contamination of your system, nor for any delays, inaccuracies, errors or omissions arising out of your use of this site or with respect to the material contained on this site.
